Bihar RERA Imposes New Charges on Builders for Expanding Projects Beyond Approved Plans
Patna: Builders in Bihar will now face additional charges for expanding construction beyond the approved plans under new regulations from Bihar’s Real Estate Regulatory Authority (RERA). Projects that add extra flats, shops, or offices beyond the originally sanctioned map will incur fees ranging from Rs. 2 lakh to Rs. 8 lakh, depending on the number of additional units. Moreover, builders will be required to obtain the written consent of two-thirds of the existing allottees for such expansions.
According to RERA’s directive, projects that add up to 20 extra units will incur a Rs. 2 lakh surcharge. For expansions involving 21 to 40 units, the fee rises to Rs. 4 lakh; for 41 to 60 additional units, it will be Rs. 6 lakh, and projects with over 60 added units will face an Rs. 8 lakh charge.
To proceed with any expansion, builders must submit detailed information on all current allottees, including names, email addresses, and contact details. A two-thirds majority consent from these allottees, provided via affidavit, is mandatory. Builders must also attest, through affidavit, that the provided details are accurate, with the risk of punitive action if discrepancies are found.
In addition, builders will need to submit an updated project map, a revised building permit, and a modified sale agreement for the newly added units. This measure aims to enhance transparency and protect the rights of property buyers in Bihar.
