Patna: Amid the ongoing political debate over reservation and the creamy layer in Bihar, the state government has issued important instructions regarding the Non-Creamy Layer (NCL) Certificate.
The General Administration Department has directed all district magistrates and concerned officials to ensure strict compliance with the rules already prescribed for issuing NCL certificates.
The department has particularly clarified that applicants do not necessarily have to obtain separate caste, residence and income certificates first and then apply for an NCL certificate.
The clarification is expected to provide relief to candidates who require NCL certificates for government jobs, competitive examinations and other official purposes.
Separate Certificates Not Mandatory Before NCL Application
A letter issued by Divakar Mani, Under Secretary, General Administration Department, refers to earlier departmental circulars, including Circular No. 11490 dated August 16, 2012.
Under the existing provisions, information relating to caste, residence and income is required for issuing an NCL certificate. However, applicants are not required to first obtain separate certificates for all three details before applying for the NCL certificate.
This means the administration can issue the NCL certificate directly after verifying the required information according to the prescribed procedure.
The clarification aims to prevent applicants from being subjected to unnecessary paperwork and repeated visits to government offices.
NCL Certificate Contains Caste and Residence Details
The government has also referred to Clause 6 of the August 16, 2012 circular.
Under this provision, the NCL certificate contains details regarding the applicant’s caste and residence. The certificate is therefore recognised for these purposes as well, subject to the applicable rules.
The clarification means applicants should not be required to obtain separate documents for information that is already incorporated into the NCL certificate.
Existing NCL Certificates Can Remain Valid
The government has also reiterated provisions concerning previously issued NCL certificates.
Referring to Circular No. 15440 dated December 5, 2017, the department stated that an NCL certificate does not necessarily need to be issued repeatedly.
If a person already holds an NCL certificate and continues to remain outside the creamy layer under the applicable conditions, the earlier certificate may be accepted on the basis of the prescribed self-affidavit (Form-XVIII B).
This provision could help candidates who otherwise face difficulties obtaining a fresh certificate each time they apply for a recruitment process or examination.
Clear Rules on Calculation of Parents’ Income
Income calculation is one of the most important aspects of determining NCL status.
The department has directed officials to strictly follow the relevant Central Government guidelines while determining eligibility.
In particular, officials have been instructed to follow provisions under which income from parents’ salaries and agricultural income is not to be clubbed together for determining annual income, wherever the prescribed rules provide for such treatment.
Officials are therefore required to assess income strictly according to the applicable provisions rather than adopting different methods at the local level.
Important Document for Government Jobs and Exams
NCL certificates are important for candidates belonging to the Backward Class (BC) and Extremely Backward Class (EBC) categories for various government recruitment processes and competitive examinations.
Recruitment notifications may require candidates to submit an NCL certificate for claiming benefits available under the applicable rules.
A simplified certificate process can therefore help candidates, particularly those who need to arrange documents close to recruitment or examination deadlines.
Online Application Facility Available
The Bihar government’s online public service system also provides a facility to apply for an NCL certificate for Bihar government purposes.
The certificate issuance process operates through the circle, subdivision and district levels, according to the applicable administrative procedure.
Digital delivery options include the online portal as well as channels such as SMS, email and DigiLocker, along with services available through RTPS/CSC facilities.
Officials Directed to Ensure 100% Compliance
The General Administration Department has stated that it received information indicating that earlier departmental instructions regarding NCL certificates were not being followed completely in some cases.
The department has consequently directed all district magistrates and subordinate officials to ensure 100% compliance with the provisions contained in the relevant departmental circulars.
The emphasis is on preventing applicants from being asked for unnecessary additional documents and ensuring that certificates are issued according to the rules already in force.

The government’s letter assumes significance amid the ongoing political debate in Bihar over reservation and the creamy layer.
However, the latest instructions do not announce any change in the creamy-layer income limit or reservation policy. The focus of the communication is primarily administrative—it seeks to clarify how NCL certificates should be issued under existing rules.
For BC and EBC applicants, the key takeaway is that they should not face unnecessary documentation requirements while applying for an NCL certificate.
