RERA Bihar Chairman Warns Promoters of Stern Action for Non-Compliance

Patna: Real Estate Regulatory Authority (RERA), Bihar Chairman Vivek Kumar Singh on Tuesday said that stern action would be taken against promoters who would not adhere to the orders of the Authority.

All possible action, permitted by the law, would be taken against defaulters and it includes steps like imposition of penalty, confiscation of movable and immobile assets of the defaulter and if needed arresting the person,” said the Chairman while addressing a sensitization workshop of promoters whose registration of project is set to lapse by September 30.

Outlining the purpose of the workshop, Singh said that the Authority stood for timely completion of project and the workshop aimed at timely intervention before registration gets lapsed. “The workshop is a platform using which we are trying to tell promoters that they should take corrective steps well in advance to ensure timely completion of registered projects.”

He also urged the promoters that before applying to get their projects registered with RERA, they should first do the homework properly and provide all the requisite documents with the application for its quick disposal.

Singh said that extension of registration would be granted in exception cases only and that too after levying additional surcharge and other details related to allottees who have already booked flats in such projects.

Speaking on the occasion, RERA Bihar Member Nupur Banerjee said that promoters needed to be active right from the time of registration of the project so that all the works could be completed in stipulated time. “Timely completion of projects would not only benefit allottees but it would also be beneficial to promoter as they would be saved from the complications that develop in case project gets delayed.

RERA Bihar Member S D Jha said that the Authority stood for both regulation and development of the real estate sector with special emphasis on safeguarding the interests of the allottees. He also said that penalty is imposed only if the defaulter fails to adhere to the provisions of the Act and directions of the Authority.

Senior RERA officials including Secretary Rajesh Thadani, Adjudication Officer A K Tiwari and Senior Legal Consultant Ved Prakash also took part in the workshop.

Registration of 41 registered projects is set to lapse by September 30, 2024. Based on the details provided by such promoters in their quarterly progress report, it emerged that while 20 of these projects were on the verge of completion, there were 11 projects in which progress is slow and in ten of these projects either the compliances have not been made or the project has not taken off.

A presentation was also made in the workshop in which details of status of 41 projects were explained. Apart from giving details about the course correction required from the promoters of slow progress projects and defaulters was explained, the presentation also briefed the points which promoters need to follow for timely completion of their projects.

During the question-and-answer session, doubts of the participating promoters were also addressed Chairman, Members and senior officials of the Authority.
