Patna: The Patna Municipal Corporation (PMC) has directed executive officers across all zones to conduct regular hearings in cases involving unauthorized non-residential use of buildings and premises in residential areas.
Municipal Commissioner Yashpal Meena instructed zonal officers to ensure that cases involving notices issued to property owners are heard regularly and disposed of promptly in accordance with applicable rules.
Zonal-Level Hearings
The municipal commissioner directed the establishment of an effective zonal-level system to hear objections, documents and representations submitted by property owners who have received notices.
Officials have been instructed not to keep such cases pending unnecessarily and to take decisions after examining the submissions in accordance with the prescribed rules.
Action Under Bihar Municipal Act
The PMC said the hearings and related action will be carried out under Section 27A(5) of the Bihar Municipal Act, 2007.
The provision allows the chief municipal officer to delegate powers, responsibilities and functions to subordinate officers. The PMC will use this provision to facilitate hearings and necessary action at the zonal level.
Supreme Court Order
The civic body said the action follows compliance with an order of the Supreme Court in Case Nos 8044-8045/2025, Loganathan vs The State of Tamil Nadu & Ors.
The PMC has identified buildings and properties within its jurisdiction where non-residential activities are being carried out in designated residential areas. Notices have subsequently been issued to the concerned property owners.
The owners are being given an opportunity to present their cases before the authorities. The PMC has directed zonal officers to expedite the hearing process and dispose of the cases in accordance with the rules.
The civic body said the move aims to ensure compliance with sanctioned land and building use regulations in residential areas and address inconvenience caused to residents by unauthorised activities.
