Bihar NH Construction Rules: No New Buildings, Shops Within 15 Metres of Highways, Government Drafts Strict Policy

The Bihar government is planning to ban all new construction activities within 15 metres on either side of National Highways. The proposed policy, drafted by the Road Construction Department, follows Supreme Court directions on highway encroachments and road safety.

Patna: The Bihar government is preparing to introduce a stringent policy that would prohibit any new construction within 15 metres on either side of National Highways (NHs) across the state.

The proposed regulation is aimed at preventing encroachments, improving visibility for motorists and reducing road accidents. Under the draft policy, no houses, shops or commercial structures will be allowed within the designated buffer zone along National Highways.

Officials said the Road Construction Department has already prepared the proposal and initiated consultations with relevant departments before seeking cabinet approval.

Proposal Based on Supreme Court Directions

The move comes in response to directions issued by the Supreme Court regarding the removal of encroachments and regulation of construction activities along National Highways.

According to officials, the proposal is being examined by several departments, including the Transport Department, Traffic Police and Law Department. Discussions are focused on addressing legal, administrative and technical aspects before the policy is finalised.

Once the consultation process is completed, the proposal will be placed before the state cabinet. Following approval, the new rules are expected to be implemented across Bihar.

Restrictions to Apply Across Bihar

The proposed no-construction zone will cover both urban and rural stretches of National Highways passing through the state.

Under the draft policy, landowners with properties adjoining highways will be permitted to use the 15-metre corridor only for limited purposes such as access roads, plantation and agricultural activities. However, permanent or temporary structures will not be allowed within the restricted area.

Officials believe the measure will help maintain clear sightlines along highways and improve overall traffic safety.

Government Intensifies Anti-Encroachment Efforts

The proposed policy comes at a time when district administrations across Bihar are conducting anti-encroachment drives along National Highways to remove illegal structures.

The government expects the new framework to strengthen enforcement efforts and prevent future encroachments on highway corridors. Authorities say the policy will also support long-term road infrastructure planning and safer travel conditions across the state.

If approved, the regulation could significantly change land-use practices along National Highways while creating dedicated safety buffers on both sides of major roads in Bihar.
