Patna: Bihar chief minister Nitish Kumar has resigned from his membership of the state legislative council following his election to the Rajya Sabha earlier this month.
The resignation was submitted to the council chairman Awadhesh Narayan Singh through MLC Sanjay Gandhi, who handed over the letter at the council premises on Monday.
State minister Vijay Kumar Chaudhary said the move was part of a constitutional process requiring members elected to Parliament to relinquish their position in the state legislature within a stipulated period.
“Nitish Kumar has been elected to the Rajya Sabha and was required to resign from the legislative council. The resignation has been submitted accordingly,” Chaudhary said.
Kumar was elected to the Rajya Sabha on March 16 along with other NDA members, including BJP national president Nitin Nabin.
Under constitutional provisions, an individual cannot simultaneously remain a member of both Parliament and a state legislature, and must resign from one within 14 days of election.
Senior Janata Dal (United) leaders, including Rajiv Ranjan Singh and Sanjay Kumar Jha, were present at the chief minister’s residence earlier in the day, where discussions were held ahead of the formal submission.
Separately, BJP leader Nitin Nabin has also resigned from his position as MLA from the Bankipur constituency, with party officials confirming that his resignation would be processed.

Bihar legislative assembly speaker Prem Kumar said Kumar could continue as chief minister for up to six months even after stepping down from the legislative council, in accordance with constitutional provisions.
The developments mark a transition phase in Bihar’s political landscape as senior leaders move to new roles at the national level.
