Patna : The District Consumer Disputes Redressal Commission, Patna, has passed orders in two consumer cases, directing a builder to pay Rs 11.25 lakh in compensation for failing to provide promised flat amenities and an insurance company to settle a vehicle repair claim it had rejected.
The judgments concern complaints involving deficiencies in housing services and vehicle insurance. The commission directed the parties concerned to provide financial relief to the consumers, including compensation, litigation costs and, in the insurance case, interest on the unpaid claim.
The orders were passed by Commission President Prem Ranjan Mishra and member Rajnish Kumar.
Builder Ordered To Pay Rs 11.25 Lakh Over Missing Flat Amenities
In Consumer Complaint No. 39/2017, filed by Sajal Kumar Sharma against R.D. Eco Developers Private Limited and others, the commission delivered its judgment on October 8, 2026.
The complainant alleged that several facilities specified in the flat sale agreement had not been provided even after possession was handed over. These included a lift, generator, fire-fighting equipment and additional electrical points.
According to the complaint, the buyer had to arrange the missing facilities at his own expense.
After examining the documents and the sale agreement, the commission allowed the complaint and directed the builder and other opposite parties to pay a total of Rs 11.25 lakh.
The compensation comprises:
- Rs 10 lakh for the failure to provide the agreed amenities.
- Rs 1 lakh for mental agony and physical harassment.
- Rs 25,000 towards litigation costs.
The order requires payment within 120 days of receipt of a copy of the judgment. If the parties fail to comply within the prescribed period, interest at 18% per annum will be payable thereafter, as stipulated in the order.
Insurance Company Ordered To Pay Vehicle Repair Costs And Interest
In a separate case, Consumer Complaint No. 320/2019, filed by Juhi Kumari against Reliance General Insurance Company Limited, the commission delivered its judgment on September 29, 2026.
The complainant’s Mahindra Scorpio S6 Plus was involved in an accident, resulting in repair expenses of Rs 85,092. She submitted an insurance claim, which the company rejected on May 31, 2019, citing allegedly incorrect information relating to the No Claim Bonus (NCB).
After examining the evidence, the commission found the grounds for rejecting the claim unacceptable and partly allowed the complaint.
Commission Cites Verification Requirements For No Claim Bonus
In its order, the commission referred to General Regulation 27 (GR-27) of the Indian Motor Tariff, concerning the verification of a No Claim Bonus when a new insurer grants the benefit.
According to the order, the new insurer was required to seek verification from the previous insurer within the stipulated period of 21 days. The commission observed that the verification had not been carried out within that period.
It consequently set aside the insurance company’s claim-rejection letter and directed it to pay the complainant the following amounts:
- Rs 85,092 towards vehicle repair expenses.
- 12% annual interest on the repair amount from May 31, 2019, until actual payment.
- Rs 20,000 as compensation for mental agony and harassment.
- Rs 10,000 towards litigation costs.
The company has been directed to comply with the order within 60 days of receiving a copy of the judgment.
Consumer Commission Emphasises Accountability
The two judgments address separate consumer grievances involving contractual obligations and insurance services. In the housing case, the commission ordered compensation for amenities that the buyer said were promised but not provided. In the insurance case, it directed payment after finding the stated grounds for rejecting the claim unacceptable.
The orders underscore the importance of fulfilling contractual commitments and handling consumer claims in accordance with applicable rules.
Consumers who face similar disputes may approach the appropriate consumer dispute redressal commission for relief, subject to the applicable legal requirements and procedures.
