Patna: A Patna civil court has dismissed a transit remand plea filed by the Andhra Pradesh police against IPS officer M Sunil Nayak, citing procedural lapses and the absence of required documents.
Earlier in the day, a team from the Andhra Pradesh police reached Nayak’s residence in Patna and took him into custody. A case has been registered against him under Section 307 of the Indian Penal Code, which pertains to attempt to murder. The case is reportedly linked to an earlier matter involving former MP K Raghurama Krishna Raju of Narsapuram in Andhra Pradesh in 2021.
The matter of his custody was heard in the court of ACJM-12 on Monday afternoon, which observed that the visiting police team did not possess a valid arrest warrant or an updated case diary. The court expressed displeasure at the failure to follow due process and rejected the remand application.
According to sources present in court, three personnel from the Andhra Pradesh police appeared without uniform, drawing further reprimand from the bench.

Nayak, who is currently posted as inspector general of Bihar Home Guard and Fire Services, left the court premises after the order. Police personnel stationed outside greeted him following the ruling.
Patna Central superintendent of police (SP) Bhanu Pratap said the Andhra Pradesh police had arrived without a warrant to make an arrest, adding that Patna police had extended cooperation. However, once the matter reached court, transit remand was denied.
Nayak’s counsel, Amit Srivastava, alleged that the visiting police personnel had ignored legal procedures and entered his client’s residence by scaling a wall. He said the matter would be challenged further.
According to the defence, the court has directed that no coercive or punitive action be taken against Nayak for the next 30 days, providing temporary relief while the legal process continues.
