Patna: The Patna High Court has ruled that compassionate appointments cannot be granted if the dependent family of a deceased employee already has an adequate source of income.
Dismissing a petition filed by Sittu Kumar, a single-judge bench led by Justice Parth Sarthi upheld the decision of the Begusarai District Compassionate Committee.
Case Background
The petitioner had sought a government job on compassionate grounds following the death of his father, Binod Sharma, a havildar in the Bihar Special Armed Police, who died of cancer in March 2016.
He argued that his elder brother was living separately and that he was responsible for supporting the family.
Committee’s Decision Upheld
The case had earlier been referred back to the authorities in 2022, when the court directed the Director General of Police, Bihar, to reconsider the application in light of a full bench ruling.
Following a review, the district committee rejected the claim in July 2023.
Court’s Observation
The state argued that the petitioner’s elder brother was employed as a jail police warden and earned a regular income sufficient to support the family.
The court observed that the committee had considered all relevant factors before arriving at its decision and found no legal infirmity in the rejection.
On these grounds, the court dismissed the plea, holding that the claim lacked merit.
