Patna: The Patna High Court has directed the Bihar government to file its response in connection with a petition seeking the quashing of an FIR registered against educator Faisal Khan, popularly known as Khan Sir.
Hearing the matter, the vacation bench of Justice Chandrashekhar Jha granted the state government four weeks to submit its reply. The petition challenges the FIR lodged at Kadamkuan Police Station in Patna.
FIR Registered Over June 2 Incident
According to court records, the FIR was registered on June 5 against Faisal Khan and his security guard. The case includes allegations related to attempted murder and provisions of the Arms Act.
The FIR stems from an incident that allegedly took place on June 2 near Khan Sir’s coaching institute in Patna. Police claim the security guard fired a weapon during a clash in the area, following which an investigation was initiated.
Petitioner Seeks Quashing of FIR
During the hearing, counsel for the petitioner argued that the FIR amounted to an abuse of the legal process and sought its quashing.
The High Court did not pass any order on the merits of the case at this stage and instead directed the state government to place its position on record through a detailed response.
Interim Protection from Arrest Remains
The court was informed that interim protection against arrest has already been granted in the matter by a Patna court.
With the state government now required to submit its reply, the High Court has listed the matter for further hearing after four weeks.
The case will be taken up again once the government’s response is filed and placed before the court.
