Patna: The Bihar Real Estate Regulatory Authority (RERA) has intensified action against builders and promoters who fail to comply with its orders, launching a special recovery drive aimed at securing dues for homebuyers and recovering penalties imposed for violations.
The authority said the drive has already resulted in recoveries in several cases over the past month. In one major case, a defaulting promoter was detained by police and produced before the court after repeatedly failing to comply with an order directing payment to a homebuyer.
Promoter detained after failing to pay homebuyer
In Certificate Case No. 4924/2025-26, involving Egion Construction Private Limited, the promoter paid a total of ₹13 lakh to complainant Md. Kashif Yunus on August 18.
The dispute dates back to a RERA complaint filed against the company. In 2022, the authority ordered payment of ₹67.64 lakh to the complainant. However, the builder failed to comply with the order, following which an execution petition was filed.
A certificate case was subsequently initiated to recover the outstanding amount. According to RERA, the promoter repeatedly failed to appear before the court, resulting in the issuance of a warrant.
On August 18, police detained the promoter and produced him before Certificate Officer Animesh Pandey. During the proceedings, ₹5.80 lakh was paid in cash, while a cheque for ₹7.20 lakh was subsequently encashed. Six post-dated cheques were also submitted towards payment of the remaining amount in instalments.
Other homebuyers also receive payments
In another case involving Sarvodaya Marketing Private Limited, complainant Pawan Kumar Agarwal received a cheque for ₹7 lakh against outstanding dues of ₹29.51 lakh.
In a separate certificate case involving the same promoter, complainant Piyush Srivastava received another ₹7 lakh cheque. The promoter had previously refunded ₹27.50 lakh, leaving ₹11 lakh still outstanding.
RERA also recovers penalties from promoters
The recovery campaign is not limited to homebuyers’ dues. RERA Bihar has also initiated proceedings to recover penalties imposed on promoters for violations of the RERA Act.
A ₹10 lakh penalty imposed on Technoculture Building Center Private Limited in connection with its Vastu Vihar, Motihari-Phase III project has been recovered through certificate proceedings.
Similarly, a ₹10 lakh penalty imposed on Abu Construction Private Limited has also been recovered after the amount remained unpaid.
Recovery mechanism strengthened
RERA Bihar has strengthened its enforcement mechanism by assigning senior officials the responsibilities of Certificate Officers. Their recovery courts operate within the RERA premises, allowing homebuyers to pursue recovery of amounts awarded by the authority through certificate proceedings.
The move is expected to increase pressure on promoters who delay or avoid complying with RERA orders. For homebuyers, the mechanism provides a more direct route for pursuing recovery after a favourable order.
The intensified recovery drive signals a stricter enforcement approach by Bihar RERA, particularly in cases where builders fail to honour orders or pay amounts due to homebuyers.
